Terms of Service

Last updated: January 15, 2024

These Terms of Service govern your use of TrustFlow’s review management platform. By using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using TrustFlow’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

These terms apply to all users of TrustFlow, including advertisers who post review tasks and reviewers who complete tasks. We may modify these terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our services after any modifications constitutes acceptance of the updated terms.

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. In such case, “you” and “your” will refer to that entity.

2. Service Description

TrustFlow operates a platform that connects advertisers seeking authentic reviews with real users willing to provide honest feedback about products and services. Our service facilitates the creation, management, and delivery of review campaigns across various platforms including Google Maps, App Store, Google Play Store, Yelp, and other review platforms.

Advertisers can create tasks specifying their requirements including target platforms, geographic regions, languages, scheduling preferences, and budget constraints. Reviewers can browse available tasks and select those that align with their interests and qualifications.

We provide tools for campaign management, progress tracking, analytics, and quality control. However, TrustFlow is not responsible for the content of reviews or the actions of individual users on third-party platforms.

Our service includes features such as automated scheduling, demographic targeting, review moderation options, screenshot verification, and comprehensive reporting dashboards to help advertisers maximize the effectiveness of their review campaigns.

3. User Accounts and Registration

To use TrustFlow’s services, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. If you are creating an account on behalf of a business, you must have the authority to bind that business to these terms.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. TrustFlow will not be liable for any losses caused by your failure to comply with these security obligations.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or otherwise harmful behavior. Account holders are prohibited from creating multiple accounts to circumvent platform limitations or restrictions.

4. Advertiser Obligations and Conduct

Advertisers using TrustFlow must ensure that their review campaigns comply with all applicable laws and the terms of service of target platforms. This includes adhering to platform-specific guidelines for reviews and not engaging in deceptive or manipulative practices.

Advertisers must provide accurate information about their products or services and may not request reviewers to post false, misleading, or defamatory content. All review requests must be for legitimate products or services that the advertiser has the right to promote.

Advertisers are prohibited from requesting reviews that violate intellectual property rights, contain illegal content, or promote harmful activities. They must respect the independence of reviewers and not attempt to coerce specific ratings or content beyond general guidelines.

Payment for services must be made according to agreed terms. Advertisers are responsible for any taxes, fees, or charges associated with their use of the platform. Refunds are provided according to our refund policy outlined in Section 8.

5. Reviewer Obligations and Conduct

Reviewers must provide honest, authentic feedback based on their genuine experience with the product or service being reviewed. They may not post false, misleading, or fabricated reviews, and must comply with the terms of service of the platforms where they post reviews.

Reviewers are required to actually use or experience the product/service before posting a review, unless the task specifically requests feedback on publicly available information such as website usability or marketing materials.

All reviews must be written in the reviewer’s own words and reflect their personal opinion. Copying content from other sources, using template responses, or posting identical reviews across multiple platforms is prohibited.

Reviewers must provide proof of their review as requested, including screenshots or links. They are responsible for ensuring their reviews remain published for the duration specified in the task requirements. Compensation is provided upon successful completion and verification of review tasks.

6. Prohibited Activities

Users may not engage in any activity that violates these terms, applicable laws, or the rights of others. Prohibited activities include but are not limited to: creating fake accounts, manipulating the platform’s systems, posting spam or malicious content, and attempting to circumvent security measures.

Users may not use automated tools, bots, or scripts to interact with the platform without explicit permission. Any attempt to manipulate rankings, ratings, or other platform metrics through artificial means is strictly prohibited.

Harassment, discrimination, or abusive behavior toward other users is not tolerated. Users may not share personal information of others without consent or engage in any form of stalking or threatening behavior.

Commercial activities outside of the intended platform functionality are prohibited. This includes direct solicitation of other users, promoting competing services, or using the platform for purposes other than legitimate review campaigns.

7. Payment Terms and Billing

Advertisers agree to pay all fees associated with their use of TrustFlow services according to the pricing structure in effect at the time of service. Fees are charged per completed review and may vary based on platform, targeting criteria, and volume discounts.

Payment is due upon completion of review tasks. We accept major credit cards and other payment methods as specified on our platform. All fees are non-refundable except as outlined in our refund policy.

Reviewers are compensated according to the terms specified for each task. Payment processing may take up to 7 business days after task completion and verification. Reviewers are responsible for reporting income for tax purposes as required by applicable law.

TrustFlow reserves the right to modify pricing with 30 days notice to existing users. Disputed charges must be reported within 60 days of the transaction date. We may suspend services for accounts with outstanding balances.

8. Refund and Cancellation Policy

Refunds are available for services not delivered as specified, technical failures that prevent campaign completion, or violations of our service standards by reviewers. Refund requests must be submitted within 30 days of the issue occurring.

Advertisers may cancel active campaigns with at least 24 hours notice. Completed reviews are non-refundable, but payments for pending reviews may be refunded if cancellation occurs before reviewer assignment.

Partial refunds may be provided for campaigns that do not meet specified delivery timelines due to platform issues or insufficient reviewer availability. The refund amount will be proportional to the undelivered portion of the campaign.

All refund requests are reviewed individually and processed within 10 business days of approval. Refunds are issued to the original payment method when possible. Repeated refund requests may result in account restrictions.

9. Intellectual Property Rights

TrustFlow retains all rights, title, and interest in and to the platform, including all software, technology, content, and materials provided through our services. Users are granted a limited, non-exclusive, non-transferable license to use the platform according to these terms.

Users retain ownership of content they create, including reviews and feedback. However, by using our platform, users grant TrustFlow a non-exclusive license to use, display, and distribute such content for platform operation and improvement purposes.

Users may not copy, modify, distribute, sell, or lease any part of our services or software without explicit written permission. Reverse engineering, decompiling, or attempting to extract source code is prohibited.

TrustFlow respects intellectual property rights and expects users to do the same. We respond to valid DMCA takedown notices and may terminate accounts of repeat infringers. Users must ensure they have rights to all content they submit or reference in tasks.

10. Privacy and Data Protection

TrustFlow is committed to protecting user privacy and complying with applicable data protection laws including GDPR and CCPA. Our Privacy Policy details how we collect, use, store, and protect personal information.

We collect information necessary to provide our services, including account details, payment information, and usage data. This information is used to facilitate transactions, improve our services, and communicate with users about their accounts.

User data is stored securely using industry-standard encryption and security measures. We do not sell personal information to third parties and only share data as necessary to provide services or as required by law.

Users have rights regarding their personal data, including access, correction, deletion, and portability. Requests can be made through our support system. We retain data only as long as necessary for legitimate business purposes or as required by law.

11. Disclaimers and Limitation of Liability

TrustFlow provides services “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our services will be uninterrupted, error-free, or completely secure. Users acknowledge that internet-based services may experience technical issues, downtime, or security vulnerabilities beyond our control.

TrustFlow is not liable for the actions of users, the content of reviews, or the policies of third-party platforms. We do not guarantee specific results from review campaigns or the permanence of reviews posted on external platforms.

Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount paid by the user in the 12 months preceding the claim. This limitation applies regardless of the legal theory of the claim.

12. Termination

Either party may terminate this agreement at any time with or without cause. Users may delete their accounts through the platform settings. TrustFlow may suspend or terminate accounts that violate these terms or engage in harmful activities.

Upon termination, users lose access to the platform and all associated data. We may retain certain information as required by law or for legitimate business purposes. Outstanding financial obligations survive termination.

Termination does not affect completed transactions or reviews already posted on third-party platforms. Users remain responsible for compliance with third-party platform terms even after account termination.

TrustFlow reserves the right to modify or discontinue services with reasonable notice to users. In such cases, we will work to minimize disruption and may provide migration assistance or refunds as appropriate.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms or use of our services will be resolved in the state and federal courts located in Delaware.

Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiations. If direct negotiation fails, disputes may be resolved through binding arbitration administered by the American Arbitration Association.

Users waive the right to participate in class action lawsuits or class-wide arbitration against TrustFlow. All disputes must be brought individually. This waiver does not apply where prohibited by applicable law.

The prevailing party in any legal proceeding may recover reasonable attorney fees and costs. Injunctive relief may be sought in court for violations involving intellectual property or confidential information.

14. Miscellaneous Provisions

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

These terms constitute the entire agreement between users and TrustFlow regarding use of our services, superseding all prior agreements and understandings. Modifications must be in writing and signed by authorized representatives.

Users may not assign or transfer their rights or obligations under these terms without our written consent. TrustFlow may assign these terms in connection with a merger, acquisition, or sale of assets.

Notices required under these terms will be sent to the email address associated with user accounts. Users are responsible for maintaining current contact information. Electronic delivery constitutes adequate notice.
